MAINELY DUCTS TERMS & CONDITIONS

  1. Scope of Work
    Mainely Ducts agrees to perform the ductwork, HVAC-related duct repairs, replacements, builds, modifications, or other listed services described in the estimate, invoice, or written agreement. Any work not specifically listed in writing is not included unless approved by Mainely Ducts and the customer.

  2. Changes to Work
    Any additional work, repairs, materials, troubleshooting, access work, or modifications requested by the customer or required due to existing site conditions may result in additional charges. Mainely Ducts will make reasonable efforts to communicate additional costs before performing work outside the original scope.

  3. Customer Responsibility and Job Site Access
    The customer is responsible for providing safe and reasonable access to the work area, including crawlspaces, basements, mechanical rooms, attics, and any other areas required to complete the project. The customer must ensure that personal belongings, stored materials, pets, and other obstacles are removed from the work area before work begins.

  4. System Startup, First Run, Testing, and Inspection
    For all duct builds, duct replacements, major repairs, system modifications, or work affecting system operation, Mainely Ducts must be present for the first system startup/run after the work is completed.

The customer agrees not to start, operate, test, or place the system into service for the first time after completion of the work unless Mainely Ducts is physically present on site.

This requirement is for safety, liability, workmanship verification, system performance, and proper final inspection. Mainely Ducts must personally inspect the completed work, run the system, verify airflow and operation, check connections, confirm that the system is functioning properly, and determine that the system is safe and properly set before the system is used.

  1. Unauthorized System Operation
    If the customer or any third party starts, operates, tests, modifies, adjusts, or places the system into service before Mainely Ducts has completed the first-run inspection and approved the system as safe and properly set, Mainely Ducts is not responsible for any resulting damage, performance issues, safety concerns, system failure, or additional repairs caused by unauthorized operation.

Unauthorized operation may void any workmanship warranty or service guarantee related to the completed work, at the discretion of Mainely Ducts.

  1. Final Walkthrough and Completion
    Upon completion of the work, Mainely Ducts will perform a final walkthrough, system startup, test, and inspection. The job will be considered complete once Mainely Ducts has inspected the work, run and tested the system when applicable, and determined that the work is complete, safe, and properly set.

The customer may be present for the final walkthrough and may also have another person present if desired. Mainely Ducts will make reasonable efforts to answer questions and explain the completed work during the final walkthrough.

  1. Payment Terms
    Unless otherwise stated in writing, payment is due immediately upon completion of the final system test, walkthrough, and approval by Mainely Ducts that the system is safe, properly set, and the agreed work has been completed.

Payment may not be withheld due to scheduling delays caused by the customer, the customer’s unavailability, or the customer’s request for additional third-party inspection, unless otherwise agreed to in writing by Mainely Ducts.

  1. Delayed Final Inspection or Payment
    If the customer delays the final walkthrough, system test, first run, inspection, or payment after Mainely Ducts has completed the agreed work and offered reasonable availability to complete the final inspection, the balance may still become due at the discretion of Mainely Ducts.

Mainely Ducts reserves the right to charge additional fees for return trips, extended delays, rescheduling, or additional inspections caused by customer availability, customer-requested delays, or unauthorized use of the system.

  1. Existing Conditions
    Mainely Ducts is not responsible for pre-existing conditions, hidden damage, improper prior installation, structural limitations, electrical issues, heating or cooling equipment defects, moisture issues, pest damage, disconnected components, code violations, or other problems not directly caused by Mainely Ducts.

If pre-existing or hidden conditions are discovered during the work, additional labor, materials, or repairs may be required and may result in additional charges.

  1. Warranty and Workmanship
    Mainely Ducts stands behind its workmanship on completed ductwork and repairs. Any workmanship concerns must be reported within a reasonable timeframe. Warranty coverage does not apply to damage, misuse, unauthorized operation, third-party modifications, equipment failure, lack of maintenance, pre-existing issues, or conditions outside the work performed by Mainely Ducts.

  2. Materials and Ownership
    All materials supplied by Mainely Ducts remain the property of Mainely Ducts until the project is paid in full. Mainely Ducts reserves the right to collect payment for materials, labor, and completed work according to the payment terms stated above.

  3. Customer Approval
    By approving an estimate, scheduling work, allowing work to begin, or accepting completed services, the customer agrees to these Terms & Conditions.

MAINELY DUCTS
LIMITED WORKMANSHIP WARRANTY

Mainely Ducts provides a limited workmanship warranty for ductwork builds, duct repairs, replacements, modifications, and related services performed by Mainely Ducts for a period of one year from the date of completion and final payment.

This warranty covers defects in workmanship directly related to the work performed by Mainely Ducts. If a workmanship issue arises within the warranty period, Mainely Ducts will inspect the issue and, if the issue is determined to be caused by Mainely Ducts’ workmanship, will make reasonable repairs at no additional labor cost to the customer.

This warranty applies only when all of the following conditions are met:

The work was completed by Mainely Ducts.

The system was not operated, started, tested, modified, adjusted, altered, or placed into service before Mainely Ducts completed the required first system startup/run, final walkthrough, inspection, and approval.

Mainely Ducts was present for the first system startup/run after completion of the work.

The system was deemed complete, safe, and properly set by Mainely Ducts.

Final payment was made in full.

No person, contractor, homeowner, tenant, family member, technician, or third party has tampered with, modified, adjusted, disconnected, removed, damaged, repaired, altered, or changed any portion of the work performed by Mainely Ducts.

The system has been used in a normal and proper manner.

This warranty does not cover damage, defects, malfunctions, performance issues, airflow issues, system failure, or additional costs caused by:

Unauthorized operation of the system before Mainely Ducts’ final inspection and approval.

Tampering, modifications, adjustments, repairs, or changes made by anyone other than Mainely Ducts.

Damage caused by the customer, occupants, pets, pests, other contractors, or third parties.

Pre-existing conditions, improper prior installation, hidden damage, equipment failure, electrical issues, control issues, furnace or air handler problems, moisture issues, structural issues, code violations, or any condition not directly caused by Mainely Ducts.

Lack of maintenance, dirty filters, blocked vents, restricted returns, closed dampers, disconnected components, misuse, neglect, or improper system operation.

Normal wear and tear.

Acts of nature, water damage, freezing, flooding, fire, impact damage, or other events outside the control of Mainely Ducts.

This warranty is limited to the workmanship performed by Mainely Ducts and does not cover equipment, parts, materials, manufacturer defects, or any unrelated HVAC system components unless specifically stated in writing.

If the customer believes there is a workmanship issue, the customer must notify Mainely Ducts within a reasonable time after discovering the issue and must allow Mainely Ducts the opportunity to inspect the work before any repairs, changes, or modifications are made by another person or company. If another party performs repairs or modifications before Mainely Ducts has inspected the issue, this warranty may be void.

Mainely Ducts reserves the right to determine whether an issue is covered under this warranty after inspection. If the issue is found to be unrelated to Mainely Ducts’ workmanship, caused by tampering, caused by third-party work, caused by misuse, or caused by conditions outside the scope of Mainely Ducts’ work, the customer may be responsible for service call fees, travel fees, labor, materials, and any additional repair costs.

This warranty is non-transferable and applies only to the original customer and original job location.

By accepting the completed work and making final payment, the customer acknowledges and agrees to the terms of this limited workmanship warranty.
